NOTICE OF PUBLIC HEARING
At
its December 28, 2009 meeting, the Board of Commissioners (the “Board
of Commissioners”) of the County of Stokes, North Carolina
(the
“County”) proposes to adopt a resolution which:
1. Authorizes the County to proceed to
pay the capital costs of (a) constructing the new Nancy Reynolds Elementary
School and (b) making initial improvements related to a new community college
facility (the “Projects”), pursuant
to an installment financing contract (the “Contract”), in order to make
the Projects available to the County;
2. Authorizes
the County to proceed to provide, in connection with the Contract, as grantor,
a deed of trust and security agreement (the “Deed of Trust”) on the site of the Nancy Reynolds Elementary School
(the “Mortgaged Property”), which
Mortgaged Property will be mortgaged by the County to create a lien thereon for
the benefit of the entity, or its assigns, providing the funds to the County
under the Contract. The Nancy Reynolds
Elementary School is being rebuilt on the site of the current school that is
located at 1585 NC 66 Hwy N, Westfield, NC 27053.
The
Mortgaged Property will be subject to the mortgage provided in the Deed of
Trust. The principal amount advanced
under the Contract will not exceed $12,000,000.
On payment by the County of all installment payments due under the
Contract, the Deed of Trust and any lien created thereunder
will terminate and the County’s title to the Mortgaged Property will be
unencumbered.
NOTICE IS HEREBY GIVEN, pursuant to
Sections 160A-20 of the General Statutes of North Carolina, that on Monday, December 28, 2009 at 6:10 p.m.
in the Commissioner’s Chambers of the Ronald Wilson Reagan Memorial Building
(Administrative Building) on the 2nd Floor located at 1014 Main Street, Danbury, North Carolina, a Public Hearing will be conducted
concerning the approval of the execution and delivery of the Contract and the
Projects. All interested parties are
invited to present comments at the public hearing regarding the execution and
delivery of the Contract and the Projects to be financed thereby.

Hearing in accordance with the
Solid Waste Management Act of 1989 (G.S. 130A) on Monday, September 28, 2009 at 6:10 pm at the Ronald Wilson Reagan Memorial Building
(Administrative Building, Danbury) -
Commissioners’ Chambers, Second Floor.
The Public Hearing is to hear input regarding long range planning on
public programs, material restrictions, bans, ordinances, special waste
disposal, along with the current solid waste collection, recycling, and
disposal programs.
