Steen requested (at the request of Support Services Supervisor
Danny Stovall) to move Item D- (Discussion Agenda)”Sale of Surplus Tax
Foreclosed
Property” to the Action Agenda in order to expedite the upset bid
process if approved by the
Board. This would eliminate interest and penalties to be incurred in
the month of August.
Commissioner Lankford
requested to leave the item on the Discussion Agenda in order
to discuss other possible options for the property.
The Board unanimously
agreed to leave Item D on the Discussion Agenda.

overwhelming consensus of this work group was that, in order for
Stokes county residents to access and obtain Mental Health and Substance Abuse
services in the current system, the county must have local coordination
with and visibility to the Local Management Entity and to the service
providers. This must come from a person, or persons, who have understanding of
The Emergency Responders and Stokes County Mental Health Association will continue meeting collaboratively, and stand ready to consult/discuss ways and means for implementation of any or all of these recommendations, or others that may arise. We are committed to an active role in helping Stokes County obtain the best possible services for our residents who have mental health, substance abuse and developmental disability Issues.

The Board discussed the request from the
Stokes County Aging Planning Committee
regarding support of the “Community Dialogue” and the $500 funding
request.
The Board unanimously
agreed to fund the one time $500 allocation and requested the
YVEDDI Grant
County Manager Bryan Steen presented the
following information to the Board
regarding the Proposed YVEDDI Facility/County Garage:
·
Met with Nancy Painter-NCDOT-Financial Management
and Mike Kozak-NCDOT-Assistant Director – Public Transportation Division along
with
Executive Director JoAnn Larkins and
Transportation Coordinator Charlie Walker –YVEDDI on Thursday, June 21, 2007 to
discuss the proposed facility project
·
NCDOT noted that the Grant which had been awarded
in 2003 had lapsed and funding is no longer available
·
A needs assessment/feasibility study will have to
be completed to meet federal and state planning requirements for any new
facility project
·
Public Transportation Division would participate in
this study at a ratio of 90% while requiring YVEDDI and/or
·
If
·
Public Transportation Division will only
participate in the cost that is determined necessary by the feasibility study
for YVEDDI’s transit needs
·
A joint building project is still possible with
YVEDDI as long as the layout clearly delineates the portions of the building
and site sets aside for each one’s function
·
The 2-acre site recently deeded to YVEDDI for in
kind match could not be used for in-kind match unless the entire building on
the land is dedicated to YVEDDI Transit
·
If
·
NCDOT officials were surprised that part of the
proposed facility project was being designed for a Stokes County Garage –
NCDOT’s first notification that YVEDDI would be sharing the facility with the
County was June 21, 2007
·
If the County is interested in a joint venture with
YVEDDI, the assessment
would have to be done first

not proceed with a new transportation grant.

process regarding transferring the property back to

funding was awarded in 2003 and YVEDDI thought that everything would proceed
with a few extra steps

YVEDDI wants to work with the County on the joint
venture
Vice Chairman Walker requested that Charlie
Walker be at the next meeting to
discuss the grant.
Commissioner Lankford
noted that Charlie Walker –YVEDDI had personally quoted to
the Board at a previous meeting that the building would be started and
projected to be done by
June 30th.
Commissioner Lankford also noted that services had been offered to
YVEDDI by
the County to help with the proposed project.
Commissioner Carroll
noted that the letter from the Nancy Painter-NCDOT clearly
states that funding no longer exists.
Public Transportation Funding can’t be used for a
County facility, and the need for an assessment of the County’s current
maintenance facility.
Commissioner Smith
reiterated that the County had provided services and had offered
additional county services in order to expedite the project.
Vice Chairman Walker
noted the need for additional information regarding the
issue before making any further decision regarding any future ventures
with YVEDDI.
The Board discussed
the information provided by County Manager Steen, possibly
meeting with YVEDDI staff to discuss the issue, reversion clause in the
Deed, and the direction
the Board needs to take from this point.
Chairman Inman
requested information from Clerk to the Board Darlene Bullins (who
worked on the project while serving as Interim County Manager)
regarding a request to Charlie
Clerk to the Board
Bullins noted that the County had offered several times to contact
NCDOT officials by phone or to go to
the project and if there was anything the County could do to assist Mr.
Walker pertaining to the
proposed project.
Charlie Walker –YVEDDI
- told County staff that the County should not call

District
Committee Discussion
County Attorney Edward Powell presented the
following information (as requested by
the Board) regarding the options for a District System in
With regard to the discussion of whether the County may be divided into electoral districts for purposes of nominating and/or electing members of the Board of Commissioners, there are several statutes that govern the method of implementation of districts.
G. S. 153A-58 states that the Board may use several options for nominating and electing the members:
a. The qualified voters of the entire county shall nominate and elect all
candidates for the board.
Or the county can be divided into electoral districts, and board members apportioned to the districts so that the quotients obtained by dividing the population of each district by the number of commissioners apportioned to the district are as nearly equal as possible, and the following three options are available:
b. The qualified voters of each district shall nominate candidates an elect members who reside in the district for seats apportioned to the district, and the qualified voters of the county shall nominate candidates and elect members apportioned to the county at large, if any.
c. The qualified voters of each district shall nominate candidates who reside in the district for seats apportioned to that district, and the qualified voters of the entire county shall nominate candidates for seats apportioned to the county at large, if any, and the qualified voters of the entire county shall elect all members of the board.
d. Members shall reside in and represent the districts according to the
apportionment plan adopted, but the qualified voters of the entire county
shall nominate all candidates for and elect all members of the board.
If options b, c, or d are adopted, the board shall divide the county into the requisite number of electoral districts according to the apportionment plan adopted, and cause a delineation of the districts so laid out to be drawn up and filed as required by G. S. 153A-20, and no more than half of the board may be apportioned to the county at large.
Also, the statute provides that the Chairman of the Board may be selected from the membership of the Board by the members for a one year term, or the chairmanship may be a separate office where the qualified voters of the entire county nominate candidates for and elect the chairman for a two or four year term.
G. S. 153A-60 provides that the Board of Commissioners shall initiate any alteration in the structure of the board by adopting a resolution that shall state the following:
1. The proposed alterations.
2. Prescribe the manner of transition from the existing structure to the
altered structure.
3. Define the electoral districts, if any, and apportion the members among
the districts.
4. Call a special referendum on the question of adoption of the alterations,
which may be held at the same time of other primary, general or special
elections.
Upon adoption, the resolution shall be published in full.
G. S. 153A-61 provides for the method of submission of the proposition to the voters, and G. S. 153A-62 provides for the effective date for the alteration. G. S. 153A63 provides that a copy of the resolution must be filed in the County ordinance book.
G. S. 153A-22 provides that the Board of Commissioners may redefine the electoral district boundaries by resolution if they find as a fact there is a substantial inequality of population among the districts. This statute also provides that it does not apply to counties where the electoral districts are for residence purposes only such as in G. S. 153A-58 (3)(d) where the members must reside in the district, but are nominated and elected by all the voters of the county.
There have been numerous decisions by the state and federal courts that require that all electoral districts be substantially equal in population, and the Board must comply with these in deciding on any electoral districts they may want to create.

to discuss the Committee’s responsibilities – Discussion Agenda.

KobeWieland Copper Products, LLC
WHEREAS, North Carolina General Statute 158-7.1 authorizes a county to undertake an economic development project by extending assistance to a company in order to cause the company to locate or expand its operations within the county; and
WHEREAS, the Board of Commissioners of Stokes County has held a public hearing to consider whether to participate in an economic development project with KobeWieland Copper Products, LLC, by reimbursing KobeWieland Copper Products, LLC for the cost of machinery and equipment to be installed at its facility in Stokes County; and
WHEREAS, KobeWieland Copper Products, LLC, will purchase and install machinery and equipment, making an investment of at least $71,000,000.00 and creating at least 65 new, permanent jobs in Stokes County; and
WHEREAS, the Board of Commissioners of Stokes County has adopted an amendment to the County's budget ordinance appropriating the funds necessary to the project;
THE BOARD OF COMMISSIONERS OF
1. The County is authorized to expend up to $1,600,000.00 ($320,000.00 per year for 5 years) of county funds for the KobeWieland Copper Products, LLC project.
2. The attached contract between the County and KobeWieland Copper Products, LLC is approved.
3. The Chairman of the Board of Commissioners is authorized to execute the contract and any other documents necessary to the project on behalf of the County.
